All India Muslim Personal Law Board Rally at Azad Maidan, Mumbai

Mumbai: The 22nd convention of All India Muslim Personal Law Board (AIMPLB) which began in Mumbai Friday, ended late in the evening on Sunday with a mammoth gathering at Azad Maidan pledging to sacrifice everything in order to save the constitutional rights of Muslims.
Speakers, first for two days in different sessions at Haj House and later at the public meeting at Azad Maidan on Sunday, asserted that the board will force the government to amend the Right to Education Act (RTE), scrap the direct taxes code bill and bring changes in the wakf amendment bill 2010.

The speakers also urged the government to allow prayers at hundreds of the mosques which are under the of custody of the ASI.

“Fresh dangers are looming large as the government of the day seems to usurp the Sharia laws. But the government should note that we will sacrifice our lives but will not tolerate any interference in the Sharia”, All India Muslim Personal Law Board (AIMPLB) president Mohammad Rabey Hasani Nadvi said.

“India is a democratic country where people from all religions are given constitutional rights to practice as per their faith and belief. But attempts are on to deny Muslim their constitutional rights. It will not be tolerated”, he said.

Recalling the rights given by the Muslim rulers to everyone in India, Prof Shakil Samdani, Professor of Law at Aligarh Muslim University (AMU) said, “You are reciprocating with what the Muslims had given to this country hundreds of years back. This is not a favor to the community.”

Raising the issue of the mosques under the ASI custody, Syed Salman Husaini Nadvi said, “Drinking wine is permitted here but faithful cannot offer their prayers. What can be more shameful than this?”

Demanding amendments in RTE Act, Abdur Rahim Qureishi, assistant general secretary of AIMPLB, said, “There are provisions in the RTE Act that deny our right to establish and run religious and educational institutions. We will make it a mass movement unless this Act is amended.”

Attacking the tax bill, Qureishi said that taxing places of worship was tantamount to interference in the religious affairs of all communities. “The Bill will affect not only the mosques, but places of worship of all religions,” he added.

The AIMPLB also rubbished reports that one of the organizers of the board’s meeting, Khair-e-Ummat Trust, was a front for the banned Students Islamic Movement of India (SIMI). Denying that the Khair-e-Ummat Trust, a Dongri-based registered NGO, had any links with SIMI, the trust’s secretary, Ibrahim Khalil Abedi, said that the news was “baseless and defamatory.”

Stating that AIMPLB’s office in Mumbai is located at the Khair-e-Ummat Trust building, Qureishi alleged, “This is part of the conspiracy to defame and denigrate a Muslim organization which provides scholarships and medical help to the poor.”

UP CM Akhilesh Yadav won praise from the board members as he has assured the AIMPLB president Mulana Rabe Hasan Nadvi that the proposed law in his state which deprives married women of their rights in fathers’ agricultural property will exclude Muslims. Copies of Akhilesh’s letter to Maulana Nadvi were also distributed among the 400-odd members from across the country.

The 3-day convention was inaugurated on Friday with the opening session held at the Haj House. People from various parts of Maharashtra and the neighboring states converged at Mumbai to attend the AIMPLB historic convention.

As per BMC Act 1888, civic elections are conducted under the control, supervision and direction of the State Election CommissionBMC election 2012 Reservation process is going and the list of candidates is ready to publish on 10th August 2011. So lets wait and watch who will get reservation tickets for upcoming BMC election held in 2012.

Counting is on for the 227 wards of BMC Mumbai for which the voting was done yesterday.

Of the total of 227 seats, results have been declared for 195 seats. The ruling Shiv Sena-BJP-RPI combine may end up winning the maximum number of seats as the Shiv Sena has won 61, BJP 32 and RPI one and they are ahead in 10 more seats, but their performance is well short of half way mark of 114 seats required to retain control of India’s richest municipal body.

The Congress has won 44 seats, its ally NCP has got 12. The MNS has emerged victorious in 26 seats; while others have bagged 19 seats.

Of the 32 seats, for which counting is underway, Shiv Sena is ahead in 8 seats, Congress is wining in seven, NCP in four seats. Raj Thackeray’s MNS is ahead in one seat, RPI in two, while others are marching towards victory in nine seats – till 2.30 pm when last updates came in.

Mumbai: For the first time, Mumbai will empower women by voting for half of 227 Mumbai Municipal Corporation seats going to be held on 16th February 2012. The Maharashtra cabinet has approved 50% reservation for women in local self-government bodies in March, 2010. Being the last day on 31st January, for the submission of nomination paper, all the parties and interestingly citizens candidates are gearing up for campaign now.

After a crucial tug of war and hectic negotiation, it’s also the first time — since NCP was formed – when ruling Congress-NCP alliance will contest the Municipal corporation election jointly to take over Shiv Sena-BJP who are governing the richest civic body in Asia with an annual fiscal budget of Rs. 21,000 crore, since last 17 years.

The Congress will contest 169 seats and the NCP 58 in the 227-strong BMC house — the alliance materialised for the first time since the formation of the NCP over a decade ago.

For the first time after a break up of Udhav (son of Bal Thackrey) and Raj Thackrey (Nephew of Bal Thakrey), Shiv Sena- BJP found a new and unusual ally in the form of Republican Party of India (Athavle group).

Shiv Sena will contest 135 seats out of a total 227 seats and BJP will field candidates in 63 wards, while the RPI(A) has been given 29 seats.

Two important parties which can be kingmakers or at least spoil the chances of both the leading sides are Raj Thakrey’s Mahrashtra Nav Nirman Sena (MNS) who made major inroads in Mumbai and Nashik and Abu Asim Azmi led Samajwadi Party(SP). Both of them are going solo in this election.

New Delhi: For long it has been said that there is a competition among investigative agencies particularly to crack terror cases – nothing wrong in it – but it was also said that some innocents may be falling victim to this competition. A new case has come to light which shows that four sons of a Muslim family of Bihar’s Darbhanga district are the latest victim of the competition.

Eminent civil rights group ANHAD on Wednesday held a press conference at its office in Delhi where Taquee Ahmed narrated the saga of harassment that began on 9th December 2011 and has continued till today. He told how his brother Naquee Ahmed, who was flown to Mumbai by Special Cell of Delhi Police whom he was cooperating in a case for some weeks, was poached there by Maharashtra ATS.

The Case
Taquee and Naquee Ahmed live in Abul Fazal, New Delhi. Taquee runs a shop, Luggage Mart, on the Kalindi Kunj-Sarita Vihar road. Their two elder brothers live in Mumbai, where they run a workshop to produce trolley bags. They hail from Darbhanga, where their parents still live.

Chronology of events

9th December
Razi Ahmed, resident of Mumbai, arrived in Delhi from Kolkata. He was visiting his brothers, Naquee and Taquee Ahmed, who live in Abul Fazal. He went to the parking and took an auto when two men forced themselves into the auto, sitting on each side. Razi panicked but the two men told him that they belonged to the Intelligence. They went to Shaheen Bagh bus stop. Taquee came to the bus stop and the two Intelligence men demanded that they produce Naquee before them. Taquee demanded to see their ID. After much haggling, they showed their IDs. Their names were Lalit Mohan Negi and Hriday Bhushan (belonging to Special Cell). Naquee was called to the bus stop after that. Lalit and Bhushan asked him about one Gayur Jamali (he was arrested in November 2011). Naquee said that he had social relations with him from the time they lived in Darbhanga (Bihar). They asked him if he had helped two men get accommodation in Bombay. Naquee said yes, that he had. He did not know about Gayur’s activities or intentions—knowing him socially he had helped him by puting him in touch with a broker in Bombay. The two men then asked him to cooperate with their investigation and Naquee agreed.

Naquee and his two brothers went to the Special Cell office in Lodhi Colony, where Naquee was made to talk to Gayur.

10th December
Naquee was taken to Bombay by the 10:30 Go Air flight. Naquee helped them identify the locality in which the house had been rented. It also turned out that the Special Cell had rented a place in the area to keep a watch.

They returned on 13th December.

Over the next few days, between 15th December and 7th January, Taquee and Naquee visited Special Cell office several times. They wanted to check their mobile details so both brothers left their phones in the office. Naquee went to retrieve the phones. They were both tired of the daily harassment and tension owing to these enquiries.

7th January
Naquee received a call saying that both occupants of the rented flat in Mumbai had returned and Naquee was needed for identifying them.

8th January
Naquee was taken to Mumbai on the 4.30 Rajdhani train.

9th January
They reached Mumbai. Naquee called in the evening and said that most of the work had been completed and that he would return tomorrow.

In the night, at about 11:30, the Maharashtra ATS came to Naquee’s brother’s workshop and picked up his elder brother Rafi. When Naquee came to know of this, he called up the Special Cell officer and asked why his brother was being picked up when it was known to the Special Cell that he was not involved in any criminal or terror activity. The Special Cell officer informed him that it was the ATS and not the Special Cell, which had picked up his brother. There was nothing they could do about it as the two agencies did not get along well. They asked him to come over to the house the Special Cell had rented in the ‘target area’.

Naquee then called up Nadeem, who used to live in the workshop to get an update about the situation in the workshop. Nadeem told him to come to hotel Sagar. Unknown to Naquee, the ATS had nabbed Nadeem and had laid a trap for Naquee through him. When Naquee reached the hotel, he too was nabbed.

At about 1.30 in the morning, ATS returned to the workshop and picked up Razi bhai and a worker.

11th January
Razi and Rafi were released.

13th January
Rafi picked up by ATS again.

17th January
The Ahmad’s residence in Darbhanga (village Deora Bandauli) was visited by the Maharashtra ATS late at night. A motorcycle belonging to his elder brother was seized by the ATS saying that it was stolen. The elderly parents of the Ahmads are fear struck.

Sections 419, 420 have been slapped on Naquee. Rafi has been released this evening. In effect this has been an illegal detention.
18th January
The press conference of 18th Jan. was addressed by Manisha Sethi (JTSA), Shabnam Hashmi (Anhad) and Taquee Ahmed (Naquee Ahmed’s brother).

According to the press statement, even today ATS Mumbai has landed at Taquee’s shop on Kalindi Kunj Road in New Delhi and is demanding to see him. Then 4 people from ATS including an ACP then landed up at ANHAD office where the press conference was just getting over. They interrogated Taquee for over an hour and then took him to Shaheen Bagh to pick up Naquee’s laptop.

“This is a case where the competition between two investigative agencies—Special Cell of the Delhi Police and the Maharashtra ATS—has claimed more innocents. The fight against terror has been reduced to victimization, harassment of Muslims and violation of the due processes of law. Anti-terror agencies pick up and detain people at will, in this free for all race to prove their anti-terror credentials,” civil rights activists said.

“We demand an immediate stop to this sort of terrorization of Muslim youth and their families. The process of investigation and questioning must be transparent and the due processes must be strictly adhered to. All those arrested be produced before a magistrate within 24 hours and illegal detentions and interrogations in such detention must be strictly punished,” they said.

Article of Hate – Swamy attacks EC for show-cause notice - Story of a hot war of letters between Election Commission and Subramanian Swamy

Between 1st September and 15th October 2011, there was a hot war of letters between Election Commission of India and Dr Subramanian Swamy, president of Janata Party, all beyond the media and public glare. The letters reveal that when ECI, one of the most powerful constitutional bodies in the country, asked explanations from Dr Swamy on the two written complaints over his infamous DNA newspaper article, Dr Swamy pounced on ECI and asked it to study law first and take action against its officials for issuing the notice to him. He did not reply to any issue raised in the two complaints, rather he said whatever he wrote was within the parameters of the Constitution of India.

Background

Dr. Subramanian Swamy, President of the Janata Party, in his capacity as such had authored a venomous, hate-filled article in the Mumbai-based DNA newspaper on 16th July 2011. The article was shamelessly promoting and inciting violence, hatred, ill-will and enmity between two religious communities. The article was published just 3 days after the Mumbai bomb blasts on 13th July 2011. The hateful article bordering serious violation of the word and spirit of the Constitution of India was condemned across the board and it even resulted in an overwhelming decision by the Harvard University to discontinue the courses taught by him.

Earlier, an FIR was sought to be registered by Shehzad Poonawalla, law student of Delhi, under the relevant provisions of the IPC. The National Commission for Minorities (NCM) was also petitioned by him to take appropriate action in the said matter. The Election Commission of India (ECI) was also petitioned to take appropriate action against the Janata Party since the article, which is not only unlawful but also contrary to the secular ideals of the Indian Constitution, towards which every political party has an inalienable, statutory commitment under the provisions of the Representation of People’s Act in order to be qualified for registration by the ECI. The article was authored by Dr. Swamy in his capacity as the President of the Janata Party (and appeared with this byline). Moreover, no other functionary of the Janata Party contested that the views expressed by the author were merely personal views and not that of the party. Instead, the official website of the Janata Party continues to carry this article to date. It would be pertinent to add that Dr. Swamy, in his capacity as the President of the Janata Party, has written quite a few similar hateful, distorted articles.

The Delhi Police, after having made a preliminary enquiry, went ahead and registered an FIR under the various provisions of the IPC including 153-A and a cognizable offence is prima facie made out.

The NCM too has taken necessary action and has strongly condemned the article terming it to be “unlawful”. Then NCM wrote to the ECI. Dr. Zafarul Islam Khan of All India Muslim Majlise Mushawarat and Shehzad Poonawalla filed written complaints and urged the ECI to deregister Janata Party.

The ECI, in its wisdom, issued a show cause notice (1st Sept. 2011) to the Dr. Swamy in his capacity as the President of the Janata Party calling for a reply on the contentions stated therein based upon the complaints of Poonawalla and Khan.

“I am directed to state that two complaints have been received in the Commission – one from Dr. Zafarul Islam Khan of AIMMM and the other from Shri Shehzad Poonawalla through a reference from the National Commission for Minorities. These complaints are against your article published in the DNA Newspaper on 16.07.2011. The complainants have requested the Election Commission to deregister your party (Janata Party) on the grounds of your views expressed in the above article,” the ECI said in the letter.

If further said: “The reference from the National Commission for Minorities is self-contained and the contention therein is that the contents of the article are against the constitutional provisions and principles of secularism and the provisions of Section 29A(5) of the Representation of the People Act, 1951.”

The Commission asked the Janata Party to file its reply by 9th September 2011.

Dr Swamy responded on 5th Sep. 2011. Instead of replying to complaints he said written complaints are vague and bland accusation and asked ECI if it can hold a hearing and if it can ask complainants to file submission on affidavits.

After one week, Dr Swamy shot another letter (13th Sep.) and said he stood by his views in the article. Instead of making a denial and rebuttal of the allegations and contentions stated in the notice of the ECI, (which usually forms the substratum of any reply to a legal notice) Dr. Swamy responded by making some allegations against the ECI itself. He said: “In view of delay from ECI his stand on concerned matter is this: “I stand by my views stated in the article published in DNA… It is my submission, the ideas expressed therein are squarely within the parameters of the Constitution of India in which sacred document I have always had full faith and belief.”

He did not stop at it. He said in the same letter that he wasted his time to foolish call and asked if ECI had done homework before issuing the notice.
Dr. Swamy wrote: “I deplore having to waste my time to reply to every ignorant and foolish call for my prosecution and/or explanation for such views. Further he questioned whether the ECI and NCM before taking cognizance of such “vapid” complaints made an attempt “to understand and analyse the law on the subject” He further alleged that the “ECI failed to do elementary homework on the two complaints”.

In the last paragraph of his reply he states: “I would like to refrain from actually stating that the Election Commission’s aforesaid notice amounts to misfeasance in office and a malafide exercise of its powers, but I do require you to withdraw your notice forthwith. Officials of the ECI who decided to flout the Supreme Court judgment by sending this notice must be taken to task and made accountable.”

It would be pertinent to note here that Dr. Swamy has made these defamatory charges and imputing motives against a Constitutional authority. Clearly this is nothing short of an attempt to undermine the ECI for having sent a Notice to him.

The ECI in its response on 12th Oct to Dr. Swamy’s unsubstantiated and uncharitable remarks expressed its displeasure by stating that Dr. Swamy’s letter “attempts to belittle the action taken by the Commission”.

The commission said: “The complaints contained several allegations of violation of the provisions of the Constitution, the principles of secularism etc in the views and suggestions in the article. However, his reply gave only a plain denial of the allegations and has not dealt with various issues and allegations in the complaints. The letter also attempts to belittle the action taken by the commission to call for reply of the Janata Party to the allegations in the complaints which is a well established normal practice in dealing with such complaints and petitions.”

The ECI firmly reminded Dr. Swamy that the Commission “had not asked Dr. Swamy’s reply to any calls for his prosecution or for his views expressed in the article” and “directed the Janata Party to submit its para-wise reply”.

It also pointed out that there was no flouting of any direction of the Hon’ble Supreme Court in asking the Janata Party to file its reply to the complaints.

“In your letter dated 13the Sep. a reference has been made to the judgment of the SC in Indian National Congress vs Institute of Social Welfare and ors, and it has been stated that Janata Party does not fall within any of the three exceptions made in the judgment. It is relevant to draw attention to one of the three exceptions laid down in the said judgment–

There are exceptions to the principle stated in paragraph 2 above where the ECI is not deprived of its power to cancel the registration. The exceptions are these—Where a registered political party amends its nomenclature of association, rules and regulations abrogating therein conforming to the provisions of section 29A(5) of the Act or intimates the ECI that it has ceased to have faith and allegiance to the Constitution or to the principles of socialism, secularism and democracy or it would not uphold the sovereignty, unity and integrity of India so as to comply the provisions of section 29A(5).”

The ECI further wrote in this letter: “The complaints and the reference from the NCM contained several averments and allegations that the article in question contained views and ideas which are opposed to various provisions of the constitution and the principles of secularism.”

The commission asked a para-wise reply by 31st October 2011.

Dr Swamy replied on 15th Oct and said I have not violated constitution. Rather than replying to complaints parawise, he asked Election Commission to tell him which paragraphs of his article can invite deregistration.

“I have searched my article published in the DNA titled “How to wipe out Islamic Terrorism’ and do not find anywhere or in any correspondence with the Election Commission having taken any of the above stated positions. Hence I request you to go through my article and tell me which of the paragraphs will entitle you to invoke Exception 3 in the said SC judgment.”

 

Viewpoint of Shehzad Poonawalla

Reacting to the attitude of Dr Swamy over ECI show cause notice, law student and political activist Shehzad Poonawalla told TCN: “Dr. Swamy has failed to give a satisfactory reply to the ECI until now. In fact, the last reply by Dr. Swamy seeks to put the onus on the ECI to give him an explanation rather than the other way around! Clearly, it reflects an attitude that Dr. Swamy considers himself to be higher than a Constitutional Authority. One wonders how Dr. Swamy would deem it fit to contest an election conducted by the very same ECI which he feels works inefficiently, without understanding the law and with an obvious malafide.”

Poonawalla was the first and original complainant over Dr Swamy’s article. He was the first and only to approach police to file FIR.

Poonawalla said: “It is disappointing yet not surprising that Dr. Swamy, has chosen to make totally baseless allegations of malafide and misfeasance against a Constitutional Authority like the ECI which is highly respected for its integrity and independence. Clearly, Dr. Swamy believes that he is vested with a power to sit in judgment on the actions of the ECI merely because they choose to send him a Notice. One wonders whether he would also allege malafide and misfeasance against the ECI if he were to lose an election conducted by them! This contemptuous reply to the ECI notice along with the 16th July hate-article, for which Dr. Swamy has been booked by the authorities and shown the door by Harvard University, only seem to reconfirm a forty year old long trait of him being a ‘political stunt-man of sorts’ as observed by several political commentators but his latest stunt of demeaning the ECI unfortunately does very little for resurrecting his fast balding credibility.”

Offending parts of Dr Swamy’s article highlighted by NCM

National Commission for Minorities in its letter to Election Commission on 30th July 2011, based on the written complaint from Shehzad Poonawalla, had highlighted various objectionable points in Dr Swamy’s article, which in NCM’s view constitute a criminal offence.

Some of them are as follows:

–Hindus cannot accept to be killed in this halal fashion, continuously bleeding every day till the national finally collapses…
–Muslims of India are being programmed by a slow reactive process to become radical and thus slide into suicide against Hindus…
–That they do I will not believe unless they acknowledge with pride that though they may be Muslims, their ancestors were Hindus. If any Muslim acknowledges his or her Hindu legacy, then we Hindus can accept him or her as a part of the Brihad Hindu Samaj (greater Hindu Society) which is Hindustan. India that is Bharat that is Hindustan is a nation of Hindus and others whose ancestors were Hindus. Others, who refuse to acknowledge this, or those foreigners who become Indian citizen by registration, can remain in India but should not have voting rights (which means they cannot be elected representatives)…
–Strategy: Remove the masjid in Kashi Vishwanath temple and the 300 masjids at other temple sites…
–Declare India a Hindu Rashtra in which non-Hindus can vote only if they proudly acknowledge that their ancestors were Hindus…
–Annex land from Bangladesh in proportion to the illegal migrants from that country staying in India…
–Goal 5: Denigrate Hinduism through vulgar writings and preaching in mosques and churches to create loss of self respect amongst Hindus and to make them fit for capitulation.”

NCM said the article “promotes or attempts to promote, on the ground of religion, disharmony and feelings of enmity, hatred, and ill-will between Hindus and the minorities. It promotes hatred against Muslims which is prejudicial to the maintenance of harmony between Hindus and Muslims and it is likely to disturb public tranquility. The article imputes that Muslims cannot, by reason of their being Muslims, bear true faith and allegiance to the Constitution of India or uphold the sovereignty and integrity of India. The article asserts and propagates that Muslims, by reason of their being Muslims, should be denied and deprived of their rights as citizens of India to vote. According to the article, all minorities must be told to acknowledge their Hindu ancestry failing which they should be denied voting rights. The article asserts and pleads that all Muslims are under an obligation to acknowledge their Hindu ancestry and this causes and is further likely to cause disharmony, feelings of enmity, hatred and ill-will between Muslims and Hindus. The article and its publication is a deliberate and malicious act intended to outrage the religious feelings of Muslims and deliberately and maliciously distorts history and facts to insult the Muslim religion and the beliefs of the Muslims. The article was written and published with the intent to cause fear and alarm to the public in general and Muslims in particular because it seeks to induce sections of the public to remove 300 masjids and deprive Muslims of their right to vote. The article and its publication were intended to incite persons to commit offences against the state and against public tranquility. The article and its publication was intended to incite Hindus to commit offences against Muslims by removing their masjids and denying Muslims the right to vote and further promotes international odium by calling on the public to promote hostilities against Bangladesh for the annexation of land.”

The NCM had urged the ECI to have the registration of the Janata Party granted under section 29 A of The Representation of the People Act, 1951 cancelled, and gave the reason.

“The requirement of law is that a political party while obtaining registration or to continue to maintain its registration is required to abide by the principle of secularism and bear faith and allegiance to the Constitution of India. The article of Subramanian Swamy abovementioned clearly shows that he and his Party does not abide by secularism as set out in the judgments of the Supreme Court , that the Party stands for “Hindu Rashtra”, that the Party has a pronounced anti Muslim stand which is hostile to secularism and therefore, since the stand of the Party is contrary to the Constitution of India and actively opposed to constitutional provisions, the Janata Party has lost the right to continue to enjoy registration under the Act and must be deregistered by the Election Commission of India,” the NCM had written in the complaint.

 Why all parties covet the BMC  - The announcement of civic polls for Feb 16 in Maharashtra virtually heralds the battle for the Brihanmumbai Municipal Corporation (BMC) – the country’s biggest and richest civic corporation with an annual budget of over Rs.21,000 crore.

Though the Shiv Sena-Bharatiya Janata Party (BJP) alliance is hoping to romp home for a fourth consecutive victory to control the BMC keys, they continue to look over the shoulder for the Raj Thackeray and Narayan Rane factors.

Why all parties covet the BMC

To counter the Maharashtra Navnirman Sena (MNS) threat, the Shiv Sena-BJP recently worked out an alliance with the Republican Party of India (RPI) and coined the ‘Shiv Shakti-Bhim Shakti’ slogan to attract the Dalit voters.

There is also the challenge posed by senior Congress leader and Industry Minister Narayan Rane, a former Shiv Sena heavyweight who has vowed to dislodge the saffron alliance from the BMC.

Though Rane – a former Shiv Sena-BJP chief minister – suffered a serious setback in his home turf of the coastal Konkan region in last month’s elections to smaller civic bodies, the Shiv Sena-BJP-RPI combine has not fully written him off yet.

“After we come to power in the next assembly elections, we will put him in jail,” thundered Shiv Sena senior leader Ramdas Kadam last week. He is a former leader of opposition, hailing from the Konkan like Rane.

The saffron alliance is also banking on the possible impact of Anna Hazare’s anti-corruption campaign which has mainly targeted the Congress, though recent elections have yet to conclusively establish Anna’s cutting edge.

With the recent re-mapping of constituencies and 50 percent reservations, all political parties are staring at the prospects of important leaders being rendered ‘seat-less’, and consequently defections and rebellions.

After all, the BMC is a rich and prestigious civic corporation with an annual budget in excess of Rs.21,000 crore – bigger than many Indian states or some smaller countries. It has 227 seats.

It has huge revenue sources, including octroi of around Rs.5,750 crore, property taxes around Rs.4,000 crore, and many others.

Even its expenses are massive – Rs.2,000 crore on health care, Rs.1,500 crore on education, Rs.1,800 crore on solid waste management projects, and Rs.1,250 crore on roads and other infrastructure, catering to the 18-million plus population (2011 Census) of Mumbai spread on around 425 square km surrounded by water on all sides.

Now, Mumbai is on the threshold of a major re-development and revamp, starting from the ‘underbelly’ of Dharavi slum – the largest in Asia – to the dilapidated old sections in south-central and the ancient fishing villages dotting the coastal areas of the city.

For long, Mumbai has been acknowledged as the country’s financial, commercial, Bollywood, glamour, tourism, mafia capital – a city that never sleeps. The mega-redevelopment projects on the anvil could finally pave the way to declare it as a global financial centre.

Mumbai municipal corporation poll on Feb 16

Mumbai, Jan 3 (PTI) Elections to 10 municipal corporations in Maharashtra, including Mumbai, Thane, Nashik and Pune, would be held on February 16, the State Election Commission announced here today. Elections to 27 zilla parishads in the state would be held on February 7, State Election Commissioner Neela Satyanarayan told reporters here this afternoon. The code of conduct has come into effect from today, she added. In Mumbai and nine other civic corporations, polling will be held on Thursday, a working day, while counting would be held the next day, on February 17. Polls will also be held for Ulhasnagar, Pimpri- Chinchwad, Solapur, Amravati, Akola and Nagpur civic bodies. Counting of votes for the ZP polls would be held on February 8, she said.

“The poll schedule has been made in such a way as not to impact the 10th and 12th class board examinations. The process would be completed before the exams begin,” she said. The exams are slated between February 19 and March 29 and it was not right to disturb the students, she said. Chief Minister Prithviraj Chavan had said recently that the examinations would not be postponed due to the zilla parishad and municipal corporation elections. (MORE) PTI VT NP

MUMBAI: At a time when it is already struggling to cope with a truculent ally in the Trinamool Congress, the Congress is faced with a fresh headache. Nationalist Congress Party president and agriculture minister Sharad Pawar on Sunday issued an ultimatum in the row over an alliance for the crucial Bombay Municipal Corporation polls, forcing chief minister Prithviraj Chavan to rush to New Delhi for deliberations with his party’s high command.

This came even as Congress MP Gurudas Kamat diluted his stand against the budding alliance that seeks to dethrone the Shiv Sena-BJP from the richest municipal corporation in the country.

Congress faces Pawar problem over civic polls

At the heart of the political gamesmanship is the NCP’s demand to contest 65 seats in the 232-member (five are nominated) BMC, far more than the 50-odd seats that the Congress is willing to yield. With Chavan making the February 16 civic polls a prestige issue, the Maratha strongman, emboldened by the NCP’s strong show in the recent municipal council polls across the state, is trying to squeeze the last seat from the Congress. The Congress won 83 seats and the NCP 19 in the last elections held in 2007. The Shiv Sena, with 85, and the BJP with 29 seats, managed to wrest power, while the NCP-Congress poll alliance came unstuck thanks to a dispute over a single seat.

Addressing a party workers’ rally in Mumbai on Sunday, Pawar asked the Congress to make its stand clear by Monday evening, failing which he would not hesitate to ask his workers to contest the polls independently. “Either the Congress makes up its mind on contesting the polls jointly by Monday or we go alone. In the 2007 BMC polls, there was no agreement till the last moment. As a result, both the parties had to pay a heavy price. Now, I feel that decision on an alliance should be taken quickly to avoid confusion among party workers,” Pawar said.

Justifying his party’s demand for 65 seats, Pawar said that between 2007 and 2012 there had been a change in the political situation, particularly in favour of the NCP. “Now, we have more legislators and an MP too,” he said, adding, “Compared to the NCP, the Congress is no doubt an important and bigger political party, but at the same time it should not take the NCP for granted.”

Rattled by Pawar’s ultimatum, Chavan said he was sure that an agreement would be reached between the two parties on seat-sharing. “I discussed the issue with my party MPs, legislators and senior office-bearers. I am positive on contesting the polls with the NCP. Since there is pressure on both the political parties, the chances of an alliance are good and I am confident that the row will be resolved amicably. We are in the process of meeting NCP leaders either on Monday or Tuesday,” Chavan told TOI.

On his visit to New-Delhi, Chavan denied that it was prompted by Pawar’s ultimatum. “My visit to New Delhi was planned. I have some official meetings there and I will be back on Monday. We will then resume negotiations,” Chavan said. However, sources maintained that the final decision on an alliance would be taken in Delhi.

On Sunday, Chavan had prolonged meetings with Congress MPs Sanjay Nirupam, Milind Deora, Gurudas Kamat, Eknath Gaikwad and Priya Dutt on sharing of seats and drawing up a strategy for the civic polls. “Everyone has given us their views and we feel that now there are fewer hurdles for sharing of seats,” Chavan said.

MPCC president Manikrao Thakre and his Mumbai counterpart Kripa Shankar Singh too endorsed Chavan’s view saying that in the ultimate process, they were sure of an alliance with the NCP. “We are determined to dislodge the Sena-BJP from the BMC. Though there are some disputes on sharing of seats, we expect to resolve them amicably,” Thakre said.

Congress faces Pawar problem over civic polls

On the deadline set by Pawar, Thakre said he too had seen his statement on the electronic media, but he felt that in any crucial political process, some more time would have to be given for deliberations. “We are keen for a quick settlement. We are meeting on Monday and Tuesday to try and reach an agreement. Let us hope that it will be resolved amicably,” he said.

A senior Congress minister said the demand by the NCP for 65 seats appeared to be unrealistic. “In the 2002 civic polls, the NCP’s total strength on the basis of first, second and third position was 50, while in 2007, it drastically reduced to 34. Now it is demanding 65 seats. We have indicated that the Congress is prepared to share between 45 and 55 seats, but so far the NCP has not made its mind known. We can’t grant them 65 seats, they will have to reduce their demand reasonably,” he said.

In a related development, Congress MP Gurudas Kamat, who had strongly opposed an alliance with the NCP, on Sunday diluted his stand saying that only if there was a reasonable demand should the Congress join hands with the NCP. Kamat could not be reached for comment, but senior leaders who attended the CM’s meeting confirmed his statement. Congress MP Sanjay Nirupam strongly advocated the case for an alliance with NCP. “If our aim is to dislodge the saffron combine from the BMC, then we must contest the polls with the NCP,” he said.
